Best Check Dishonor Lawyer in Bangladesh

Check Dishonored

A cheque is a negotiable instrument that is used to pay money. When a cheque is dishonoured, it means that the bank refuses to pay the money that is due on the cheque. There are many reasons why a cheque may be dishonoured, such as insufficient funds, closed account, or a stop payment order.

In Bangladesh, the Negotiable Instruments Act, 1881, governs the law of cheques. Section 138 of the Act makes it an offence to dishonour a cheque for insufficiency of funds. The punishment for this offence is imprisonment for a term which may extend to one year, or with a fine which may extend to thrice the amount of the cheque, or with both.

The person who is aggrieved by the dishonour of a cheque may file a complaint with the police. The police will then investigate the matter and, if they find that there is a prima facie case, they will file a chargesheet against the accused person. The accused person will then be tried in a court of law.

If the accused person is found guilty, he/she will be punished as per the law. In addition to the punishment under Section 138 of the Negotiable Instruments Act, the accused person may also be liable to pay damages to the aggrieved person.

The following are some of the legal remedies available to a person whose cheque has been dishonoured:

  • Criminal complaint: The person can file a criminal complaint with the police against the person who has dishonoured the cheque.
  • Civil suit: The person can file a civil suit against the person who has dishonoured the cheque for recovery of the amount of the cheque, as well as damages.
  • Banking Ombudsman: The person can also file a complaint with the Banking Ombudsman against the bank that has dishonoured the cheque. The Banking Ombudsman is an independent body that is set up to resolve disputes between banks and their customers.

If you have a cheque that has been dishonoured, it is important to seek legal advice to find out what your legal options are.

Here are some additional things to keep in mind:

  • If you are the person who has dishonoured a cheque, it is important to take steps to clear the cheque as soon as possible. This will help to avoid any legal problems.
  • If you are a business owner, it is important to have a clear policy on the use of cheques. This will help to prevent cheques from being dishonoured and will protect your business from legal problems.
